i believe hes using the DD-7 which lets you record up to 16mins (i think) . When you press hold it lets u over dub it as shown in this clip
its by BOSS and it ranges from 150-170. go look up paul gilbert playing arpeggios with his ass XD he explains it.

You can play legato while picking, just not on the same string.

cause the bottom guitar only has three strings on it so he can play the solo the top has all six. some guitars have a different amount of strings on one of the necks. and some just have differnet tuning
